1. Introduction
Welcome to educhate.
educhate is a free educational platform designed to support teaching, learning and revision through digital resources and interactive classroom activities.
The platform is independently developed and operated in the United Kingdom as a non-commercial educational project.
These Terms of Service explain how educhate may be used, the responsibilities of users and the permissions associated with educational resources.
By accessing or using educhate, users are expected to follow these terms.
Where agreement to particular terms is required, educhate will seek that agreement through an appropriate process.
If you do not agree with these terms, you should not use the platform.
2. About educhate
educhate provides educational tools and resources intended primarily for teachers and students.
These include:
- GCSE revision resources and educational explanations.
- Interactive quizzes and knowledge checks.
- Programming activities, including Parsons puzzles.
- Digiboards and classroom response activities.
- Polls and word clouds.
- Teacher-created educational activities.
- Other teaching and learning resources.
educhate is currently provided free of charge.
The platform may be updated or improved over time, and the availability of individual features may change.
We aim to provide a reliable and accessible educational service, although occasional interruptions may occur.
3. User Accounts
3.1 Authentication
Teachers and administrators must sign in through Clerk, educhate’s third-party authentication provider, to access account features. Students can join Digiboards using a session code and a name or nickname without signing in to Clerk. Some educational resources are also available without an account.
Users may authenticate through supported identity providers, including Google and Microsoft.
Users should only access educhate using an account they are authorised to use.
3.2 Account Security
Users are responsible for taking reasonable steps to protect their accounts.
Users must not:
- Attempt to access another person’s account without permission.
- Impersonate another user.
- Attempt to bypass authentication or security measures.
- Deliberately interfere with another user’s access to educhate.
- Use accounts to engage in unlawful or harmful activities.
Users who believe their account has been compromised should take steps to secure it and report relevant concerns.
3.3 Account Deletion
Users may delete their authentication account through the account management functionality provided by Clerk.
Additional personal information associated with the account may be held within educhate’s database.
Deleting a Clerk account does not currently automatically remove this additional information.
Users may request the removal of remaining personal information by contacting educhate.
Further details are available in the Privacy Policy.
4. Acceptable Use
educhate is intended to provide a safe and constructive educational environment.
All users are expected to behave responsibly and treat others respectfully.
4.1 Appropriate Use
Users may access educhate to:
- Support classroom teaching and learning.
- Complete educational activities.
- Revise independently.
- Create educational resources and activities.
- Participate in teacher-led classroom sessions.
- Access and share resources in accordance with the copyright permissions outlined in these terms.
4.2 Unacceptable Use
Users must not use educhate to:
- Bully, harass, threaten or intimidate others.
- Submit hateful, discriminatory or abusive content.
- Deliberately disrupt classroom activities.
- Share another person’s private information without appropriate permission.
- Upload malicious software or harmful code.
- Attempt to damage or compromise the website.
- Gain unauthorised access to accounts, sessions or information.
- Infringe another person’s intellectual property rights.
- Engage in illegal activities.
Where misuse is identified, educhate may take proportionate action to protect users and the platform.
This may include removing inappropriate content, restricting access to particular features or suspending accounts.
We will aim to act reasonably and provide an opportunity to raise concerns where appropriate.
5. Interactive Classroom Activities
educhate provides interactive classroom tools, including Digiboards, polls and word clouds.
These tools allow teachers to create activities and students to participate.
5.1 Teacher Responsibilities
Teachers using educhate should:
- Ensure activities are appropriate for their students.
- Supervise classroom participation.
- Manage access to their classroom sessions.
- Avoid requesting unnecessary personal or sensitive information.
- Respond appropriately to unsuitable submissions.
- End activities when they are no longer required.
- Follow their school’s safeguarding and data protection procedures.
5.2 Student Responsibilities
Students should:
- Follow their teacher’s instructions.
- Submit appropriate responses.
- Treat other participants respectfully.
- Avoid sharing unnecessary personal information.
- Refrain from interfering with classroom activities.
5.3 Classroom Responses
When users participate in live activities, student responses are associated with the participant record for that session, not with a Clerk account identifier. Responses may be visible to the teacher and, depending on the activity, other participants.
When a session is ended or expires, participant records and responses are deleted from the live database. Session overviews and activity definitions are retained for the configured retention period, which is 30 days by default. Sessions expire automatically after eight hours by default if they are not ended sooner.
Additional information about data retention is available in the Privacy Policy.
5.4 Moderation
Teachers may have access to controls for managing classroom activities and submitted responses.
However, not all content is necessarily reviewed before being displayed.
educhate may take appropriate action where content is reported as harmful, inappropriate or unlawful.
Nothing in this section removes any responsibility that educhate has under applicable law.
6. Copyright and Educational Resources
6.1 Original educhate Resources
Original educational resources created by the operator of educhate remain the intellectual property of that operator, unless otherwise stated.
These may include:
- Worksheets and revision materials.
- Educational explanations.
- Quizzes and assessment resources.
- Programming exercises.
- Original diagrams and illustrations.
- Other teaching materials.
Making these resources freely available does not transfer copyright ownership to users.
6.2 Permitted Educational Use
Users are permitted to access and use original educhate resources for non-commercial educational purposes.
This includes:
- Using resources in classroom lessons.
- Downloading resources where this functionality is provided.
- Printing resources for teaching and learning.
- Sharing unmodified resources with students or colleagues.
- Displaying resources in educational presentations.
- Using resources for independent revision.
When resources are shared or reproduced, educhate must be acknowledged as the original source.
The recommended attribution is:
Source: educhate.com
Ordinary classroom teaching and learning are permitted under these terms, provided the resources are not sold or commercially redistributed.
6.3 Modifying educhate Resources
Users must not modify, adapt or redistribute altered versions of original educhate resources without permission.
This includes changing the content of worksheets, removing attribution or republishing altered resources as original work.
These restrictions do not prevent uses permitted by applicable copyright law.
6.4 Commercial Redistribution
Users must not sell or commercially redistribute educhate resources without permission from the relevant copyright holder.
This includes incorporating resources into paid resource packages or distributing them through another commercial resource platform.
6.5 Third-Party Materials
Some resources may contain or reference material belonging to other copyright holders.
Such material remains subject to the rights and permissions of its respective owners.
The educational-use permissions described above apply only to material that educhate owns or has authority to license.
7. User-Created Educational Content
educhate allows users to create educational resources and activities.
These may include:
- Quizzes and questions.
- Parsons puzzles.
- Poll questions.
- Digiboards questions.
- Word cloud activities.
- Teaching resources.
- Other educational content created using educhate.
7.1 Ownership of User-Created Content
Users retain any copyright and intellectual property rights they lawfully hold in their original content.
Creating or submitting a resource through educhate does not automatically transfer copyright ownership to the platform.
7.2 Licence to Use Educational Resources
Where a user has the necessary rights and accepts the applicable contribution terms, they grant the individual operating educhate a worldwide, non-exclusive, royalty-free licence to use their contributed educational resources.
This licence allows educhate to:
- Store and reproduce contributed resources.
- Display resources through the platform.
- Adapt and improve educational content.
- Incorporate resources into other educational activities.
- Publish resources within the educhate library.
- Distribute resources to other users for educational purposes.
- Allow users to access and use published resources under educhate’s educational-use permissions.
This permission allows educhate to develop and maintain its educational resource library without requesting additional permission for each use covered by the licence.
Contributors remain free to use their own original content elsewhere.
7.3 Private Educational Activities
The educational resource licence may also apply to original questions and activities created for individual classroom sessions, including activities that have not been made publicly available by their creator.
Where the contributor has agreed to this licence, educhate may select suitable educational content for reuse or publication.
However, this does not authorise the publication of personal information, confidential school information or material that the contributor does not have authority to license.
Creating a private classroom activity does not mean that its student responses will be published.
Users must be clearly informed of this licence before agreeing to contribute content.
The licence will not be applied retrospectively to previously submitted resources without an appropriate legal basis or agreement.
7.4 Duration of the Licence
The educational resource licence is intended to provide continuing permission for educhate to use and maintain contributed resources.
It may continue after a contributor closes their account, particularly where resources have already been incorporated into published educational materials.
This does not override applicable legal rights, including data protection rights, or allow educhate to retain personal information indefinitely.
Any requests relating to contributed content will be considered in accordance with applicable law and the relevant circumstances.
7.5 Contributor Responsibilities
Users must ensure that they have the necessary rights to contribute educational content.
Users should not upload or submit:
- Materials they do not have permission to use.
- Copyrighted resources belonging to another organisation without appropriate authorisation.
- Confidential school documents without permission.
- Resources containing unnecessary identifiable pupil information.
- Content that breaches applicable laws or the rights of others.
Materials created during employment may belong to the employer rather than the individual who created them.
Contributors must have the necessary authority to grant the permissions described in these terms.
7.6 Children’s Contributions
Educational content created by children requires particular consideration.
The educational resource publishing licence is not intended to automatically authorise the republication of children’s original work without appropriate permission.
educhate will not rely solely on a child’s ordinary participation in a classroom activity as permission to republish their work.
7.7 Student Responses
Student responses submitted through Digiboards, polls, word clouds and similar activities are treated separately from reusable educational resources.
These responses are processed to provide the relevant classroom activity.
The educational resource publishing licence does not apply to these responses.
educhate does not acquire copyright ownership of student responses simply because they are submitted through the platform.
Personal information associated with classroom responses is handled in accordance with the Privacy Policy.
8. Educational Accuracy
educhate aims to provide accurate, useful and relevant educational materials.
However, resources may occasionally contain mistakes, omissions or outdated information.
The platform is intended to support teaching and learning rather than replace official examination specifications, school guidance or professional educational judgement.
Teachers and students should consult the relevant examination board for official qualification information.
Unless specifically stated otherwise, references to examination boards do not indicate that those organisations sponsor or endorse educhate.
Users are encouraged to report inaccuracies so that resources can be reviewed and improved.
9. Children’s Use of educhate
educhate provides educational resources that may be accessed by children and young people.
We aim to provide an appropriate learning environment and clear information about how the platform operates.
Children should use educhate responsibly and follow appropriate guidance from teachers, parents or guardians.
Where educhate is used in schools, teachers should consider whether particular activities are suitable for their students.
Children should avoid sharing unnecessary personal information.
Where additional permissions or safeguards are required by law, these must be respected.
Information about the processing of children’s personal information is available in the Privacy Policy.
10. Privacy and Personal Information
educhate uses personal information to provide authentication, manage user accounts and operate educational activities.
Our Privacy Policy explains:
- What information is collected.
- How Clerk authentication works.
- What information is stored in MongoDB.
- How classroom submissions are processed.
- How long information is retained.
- How users can exercise their data protection rights.
Privacy Policy: educhate.com/policies/privacy-policy
Nothing in these Terms of Service limits rights provided by applicable data protection legislation.
11. Service Availability
educhate is currently operated as a free educational project.
We aim to provide a reliable service, but temporary interruptions may occur because of maintenance, updates or technical problems.
We may introduce new features, improve existing functionality or discontinue features where reasonably necessary.
Where significant changes are likely to affect users, we will aim to provide reasonable notice where practicable.
Teachers should consider alternative arrangements when planning activities that depend on access to the platform.
We will take reasonable care in providing educhate, but uninterrupted availability cannot be guaranteed.
12. Account Restrictions and Suspension
educhate may restrict access where reasonably necessary to:
- Protect the security of the platform.
- Prevent harmful or unlawful activity.
- Address serious or repeated breaches of these terms.
- Protect other users.
- Comply with applicable legal requirements.
Where appropriate, users will be informed of the reasons for any restriction.
Users may contact educhate if they believe action has been taken incorrectly.
Any restrictions will be considered proportionately, taking account of the circumstances.
13. Responsibility and Liability
educhate is provided free of charge as an independent educational project.
We take reasonable care in operating the platform and providing educational resources.
Users should exercise appropriate judgement when using educational materials and interactive tools.
Users are responsible for their own conduct when using the platform.
educhate remains responsible for matters for which it has legal responsibility.
Nothing in these terms excludes or restricts liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Any other matter for which liability cannot lawfully be excluded or restricted.
Nothing in these terms removes or limits users’ statutory rights.
14. External Services and Websites
educhate uses third-party services to provide certain functionality.
These include authentication and website hosting services.
Some educational resources may also contain links to external websites.
External services may have their own terms and privacy policies.
Users should review relevant information when accessing external services.
Providing a link to an external website does not necessarily indicate endorsement of its content.
15. Information for Schools
Schools and educational institutions may use educhate for appropriate educational purposes.
Before introducing educhate for use with pupils, schools should consider the suitability of the platform for their intended activities.
This includes reviewing relevant privacy, safeguarding and data protection information.
Where educhate processes personal information on behalf of a school, appropriate data protection arrangements may be required.
Schools and educhate remain responsible for fulfilling their respective legal obligations.
Nothing in these terms transfers educhate’s statutory responsibilities to schools or teachers.
16. Changes to These Terms
These Terms of Service may be updated to reflect changes to the platform or relevant legal requirements.
Where material changes affect users’ rights or responsibilities, we will take reasonable steps to provide appropriate notice.
Changes requiring additional agreement will not be treated as accepted merely because a revised document has been published.
The latest version of these terms will be available through the Policies page.
17. Governing Law
These terms are intended to operate in accordance with the laws of England and Wales.
Nothing in this section removes mandatory rights or legal protections available to users under applicable law.
